POTENTIAL VIOLATIONS <br />of <br />California Only Title 22 CCR <br />Hazardous Waste Management Requirements <br />1. Storage of RCRA Hazardous Waste without a Permit <br />22 CCR § 66262.34 states that a generator may accumulate hazardous waste on-site for <br />90 days or less without a permit or without having interim status, provided that certain <br />conditions are met. Failure to meet the conditions of the exemption subjects the <br />generator to the permitting requirements at 22 CCR § 66270.1. <br />Findings: <br />The inspectors found 2 open undated containers which were labeled only as "compressor <br />condensate" with small amounts of liquid waste inside. According to facility <br />representatives the containers were recently emptied and the waste remaining was liquid <br />residue. Containers that are not fully emptied of hazardous constituents need to be kept <br />closed and labeled and dated as required. <br />Facility Response: Subsequent to the inspection Site 300 submitted photographic <br />evidence that the locker had been cleaned out and the containers used to transfer liquid <br />waste, such as compressor condensate wastewater, were emptied and properly disposed. <br />2. Failure to Properly Manage Lead -Acid Batteries <br />22 CCR § 66266.81 states that a person who manages spent lead -acid batteries shall <br />comply with all of the requirements of subsections (a)(2) through (d) of the section <br />including labelling the packaged batteries with the date they were received. <br />Findings: The inspectors found one used lead -acid battery in a storage container in the <br />heavy equipment maintenance area which was not dated. <br />Facility Response: During the inspection a facility representative marked the date on the <br />battery, covered the terminals with electrical tape and relocated the battery to the <br />appropriate storage container. <br />12 <br />
