Log on to CERS at http://cers.calepa.ca.gov to make a <br /> hazardous waste submittal on the CERS website. For assistance, please contact Toby Morelli at <br /> tmorelli@sjcehd.com or(209)468-3421. <br /> This is a Class II violation. <br /> 301 CCR 66262.34(d)(2) Facility not maintained to minimize the release of a hazardous waste. <br /> Several oil stains were found on the pavement of the facility, underneath several vehicles, underneath a silver tool <br /> box on the south-east side of the shop, and around a floor drain near the used oil storage area in the back of the <br /> shop. Facilities shall be maintained and operated to minimize the possibility of a fire, explosion, or release of <br /> hazardous waste to air, soil, or surface water which could threaten human health or the environment. Immediately <br /> clean the oil stains, containerize the metal shavings, and manage according to Title 22 hazardous waste <br /> regulations. Submit a statement and supporting documentation explaining how this waste was managed. <br /> This is a minor violation. <br /> 403 CCR 66262.34(d)(2) Failed to keep hazardous waste containers closed except when adding or removing hazardous <br /> waste. <br /> A blue poly 30 gallon container with used oil residue located at the back of the shop was found without a cap.All <br /> hazardous waste containers shall be closed at all times except when adding or removing waste. Immediately close <br /> these containers and ensure all hazardous waste containers are closed when not adding or removing waste. <br /> This is a minor violation. <br /> Overall Inspection Comments: <br /> Notes: <br /> -The facility did not have a modified contingency plan, nor an emergency coordinator at the time of inspection. <br /> A modified contingency plan form was filled by the owner and posted by a phone at the time of inspection. <br /> Corrected on-site. <br /> -A blue poly 30 gallon drum, a white poly 10 gallon container, and an orange metal container all empty but <br /> being used for used oil were not properly labeled. The owner labeled the containers as hazardous waste with all <br /> of the appropriate information at the time of inspection. Corrected on site. <br /> The amount of hazardous waste generated in the last calendar year was not determined since the facility has <br /> not kept records for the amount of hazardous waste disposed. The owner, Domingo, stated he takes his used oil <br /> to O'Reily's or PepBoy's, but does not receive or keep a record of disposal. Domingo also stated that when his <br /> metal car parts get picked up for recycle, his used absorbent is also taken.
