One is the <br /> Hazardous Waste Emergency Information for the site and the other is the <br /> certification of Return to Compliance from the January 3, 2002 inspection, which <br /> you conducted. <br /> I would like to address item # 65, which was water in the AGT containment area <br /> for the AGTs diesel. You informed us that this was not acceptable as it reduced <br /> the amount of containment required by code to hold a spill or release from the <br /> tanks in the area. The code requires the containment area to contain 100% of <br /> the largest tank in the containment area. Attached are the calculations from our <br /> engineer that confirms the containment area is capable of containing up to 6.9 <br /> inches of rainwater as well as 100% of the largest tank. In lieL1 of this it has beer <br /> our practice to simply let the accumulated rainfall evaporate and therefore, we <br /> don't create anymore-'Hazardous material then necessary. <br /> The containment area and the AG tanks are inspected daily for any leak or <br /> release. We have never had a problem with the containment area it his well <br /> maintained and any diesel residue is cleaned on a regular process. It doesn't <br /> make a great deal of sense to create more hazardous material (the potentially <br /> contaminated rainwater) than necessary, rather than to let it evaporate. We will <br /> monitor the rainwater and if it ever exceeds 6.5 " it can be removed and disposed <br /> of properly if necessary.
