This appeal is brought pursuant to 23 CCR 2814.2 on behalf <br /> of: <br /> The Guido Segarini Trust <br /> Wendy Berndt, Trustees <br /> Post Office Box 1810 <br /> Aptos, CA 95001 <br /> The Guido Segarini Trust ("Trust" or"Claimant") appeals the decision of the Division Chief <br /> (attached hereto as Exhibit A) denying the Trust's eligibility for reimbursement from the <br /> Underground Storage Tank Cleanup Fund. The Trust received the Division's final decision <br /> on December 2, 2002. <br /> BACKGROUND <br /> Claimant applied for reimbursement from the Underground Storage Tank Cleanup Fund <br /> ("Fund") on June 7, 2002 (Application is attached as Exhibit`B"). The Fund staff, by a <br /> letter dated June 21, 2002, found its claim to be ineligible for placement on the priority list <br /> due to the fact that the Trust "was never the owner or operator of the Underground Storage <br /> Tanks." The Trust timely appealed this determination to the Fund Manager and the <br /> Division Chief, who agreed with Fund staff.
