Alpine SITE CODE: 1007 <br /> Stockton CA 95204 <br /> Dear Ms. Marler, <br /> In September 1994 you were the owner of a property located at 75 E.Alpine in Stockton CA. As the <br /> owner, you oversaw the removal of four underground storage tanks from the property. As the owner <br /> of the property at the time of the tank removals, and per California Code of Regulations Title 23, <br /> Division 3, Chapter 16, Article 11, you were named the responsible party to the contamination that <br /> leaked from the tanks. <br /> In 1998 the ownership of the property at 75 E. Alpine was transferred under a Deed of Trust to the <br /> Guido G. Segarini Family Trust(Trust). As the current property owner, the Trust was named as an <br /> additional responsible party to the site. In December 1999, at their own expense, the Trust began the <br /> site investigation with a series of direct push soil borings. Soil and grab groundwater samples were <br /> collected and analyzed. Results of the analyses indicate that there has been a petroleum <br /> hydrocarbon impact to both soil and groundwater beneath the site. The trust is interested in and <br /> willing to proceed with the site investigation, but is not able to bear the entire expense out of pocket. <br /> The State Water Resources Control Board has in place a Cleanup Fund,wherein responsible parties <br /> may be eligible for reimbursement of funds spent on the investigation and cleanup of sites <br /> contaminated with petroleum hydrocarbons that leaked from underground storage tanks. However, <br /> the criteria for eligibility to receive reimbursements from this fund are very specific. As the owner of <br /> the tanks at the time of their removal you are the party eligible to apply to the Cleanup Fund. As the <br /> property owners after the fact, the Guido G. Segarini Family Trust is not eligible. <br /> San Joaquin County Environmental Health Department and the Segarini Trust request that you <br /> contact either of us so that work at this site may proceed. You are the only responsible party to this <br /> site who is eligible for reimbursement of investigative and cleanup costs from the Cleanup Fund. With <br /> your cooperation an application can be submitted to the Cleanup Fund. Once your eligibility is <br /> approved by the fund, it may be reassigned to the Segarini Trust.
