Alpine Ave. <br /> Stockton CA 95204 <br /> San Joaquin County Public Health Services, Environmental Health Division (PHS/EHD) is in <br /> receipt of correspondence from Herum-Crabtree dated August 10, 2000 regarding the above <br /> referenced property. This property is a listed contaminated underground storage tank (UST) <br /> site currently assigned to the PHS/EHD's Local Oversight Program (LOP)for assessment <br /> and clean-up activities. PHS/EHD administers the LOP program under contract with the <br /> State Water Resources Control Board (SWRCB) agreement no. 0-014-550-0. <br /> The correspondence requests that PHS/EHD name all previous owners and/or operators of <br /> the gasoline station formerly located at this site as responsible parties to the site. Further <br /> request is made that PHS/EHD pursue the "primary" responsible parties prior to the current <br /> property owner, the Guido G. Segarini Trust, to clean up the documented contamination. <br /> California Code of Regulations, Title 23, Division 3, Chapter 16, Article 11, section 2720 <br /> defines who may be listed as a responsible party to a contaminated UST site. While there <br /> may have been several owners/operators of this site over the years, they do not fit the <br /> definition of responsible party as stated in the regulations. As regards to the issue of <br /> "primary" responsible party, a distinction between primary vs. secondary responsible party is <br /> not made in the regulations. The LOP contract sets specific criteria for when a distinction <br /> may be made between a "primary' vs. "secondary" responsible party, and those criteria are <br /> not met at this site. Copies of the pertinent sections of these documents are provided for <br /> your information. <br /> The listed responsible parties to this site are Marler Industries, Inc., the owners of the <br /> property and UST's at the time the unauthorized release was discovered, and the Guido G. <br /> Segarini Trust, the current property owner. Both are considered to be equally responsible. <br /> Marler Industries, Inc. has been recalcitrant in their responsibility, and has not been <br /> accepting certified mail sent to them by PHS/EHD at either Los Gatos address provided in <br /> the correspondence. <br /> A Division of San Joaquin County Health Care Services <br />
