San Joaquin County Public Health Services Environmental Health <br /> Division, Site Mitigation Unit , located at 304 East Weber Avenue <br /> in Stockton, has been authorized, pursuant to the California <br /> Health and Safety Code (H&SC) , Division 20 , Chapter 6 . 75, Article <br /> 4 , Sections 25299 . 36 and 25299 . 37, to spend up to $25 . 000 <br /> emergency funding to maintain the fence currently located on the <br /> site until they are able to have the open excavation backfilled <br /> and the contaminated soil stockpile disposed. Additional funding <br /> may be made available for investigation and cleanup of petroleum <br /> contamination, upon request by San Joaquin County. <br /> 2 . The State Water Resources Control Board (State Water Board) is <br /> authorized to provide this funding pursuant to Sections 25299 . 51 <br /> and 25299 . 53 of Chapter 6 . 75 (H&SC) , when the tank owner or <br /> operator fail or refuse to take the required corrective action in <br /> response to a final order for corrective action. The Emergency, <br /> Abandoned, Recalcitrant (EAR) Account was established for this <br /> purpose . <br /> 3 . The State Water Board is required, pursuant to Article 7, Chapter <br /> 6 .75, Sections 25299 .70 through 25299 .75 (H&SC) , to recover any <br /> costs incurred from the owner or operator of the UST which <br /> released the petroleum and which is the subject of these costs. <br /> Costs may include : corrective action costs; any costs incurred <br /> for Regional Water Quality Board and local agency staff time; <br /> contracting costs; and, any costs incurred by the State Attorney <br /> General ' s Office in their cost recovery efforts . <br />
