Weber Ave. — 3`d Floor <br /> Stockton, CA 95202 <br /> Regarding: Invoice for Account AR0010280 <br /> Dear Sir or Madam: <br /> Enclosed please find an invoice from your office for hazardous waste generation, PBR <br /> fees and CUPA program fees, with a check for$10. <br /> On January 1, 1999, Senate Bill 2111 took effect, which mandated that"silver-only" <br /> generators be regulated only as they are under RCRA. This means that silver <br /> generated by photo processing operations and sent to refiners for recycling is no longer <br /> regulated as "non-RCRA hazardous waste". San Joaquin County Public Health <br /> Services was apparently unaware of this regulatory change, and in January 1999, <br /> invoiced my company's photo lab at 555 Industrial Park Drive, Manteca for PBR, CUPA <br /> and generator fees totaling $2058. The invoice was mistakenly paid by plant <br /> personnel. When I discovered the error, I contacted Doug Wilson of your department, <br /> explained the effect of SB 2111, and requested a refund of $2048. Mr. Wilson <br /> responded that the department would not be able to issue a refund prior to inspecting <br /> our facility to determine regulatory applicability. <br /> I called Mr. Wilson twice again in 1999 to check on the status of our inspection/refund, <br /> and was told that we were slated for inspection, but that it would be some time before <br /> the department was able to schedule a date. I also sent a copy of DTSC's Fact Sheet <br /> concerning SB 2111, and an explanation of our regulatory status as a generator. <br /> We have now received a year 2000 invoice for fees for a generator of between 5 and <br /> 25 tons of hazardous waste, and a PBR facility.
