Class II Violation: #60,61,62 60, 61, & 62. Manifest number 007419506JJK of waste paint shipped on 03/24/2011 was found without a signed off copy from the destination facility. Hazardous waste generators shall retain copies of all manifests signed off by the destination facility on site for three years and have them readily available for review. If the generator did not receive a copy of the manifest with the handwritten signature of the owner or operator of the facility to which the generator's waste was submitted within 35 days of the date the waste was accepted by the initial transporter, the generator shall contact the transporter and/or the owner or operator of the designated facility to determine the status of the waste. If the generator did not receive a copy of the signed off copy of the manifest within 45 days of the date that the waste was accepted by the initial transporter, the generator shall submit an Exception Report that includes a legible copy of the missing manifest, and a cover letter signed by the generator explaining the efforts to locate the hazardous waste and the results of those efforts. Exception reports shall be submitted to: DTSC Report Repository, Generator Information Services Section P.O. Box 806, Sacramento, CA 95812-0806 Immediately locate a copy of the missing manifest or prepare and submit an exception report to DTSC. Correct by submitting to the EHD a copy of the signed off copy of the manifest or a copy of the exception report submitted to DTSC. Submit to SJC EHD within 30 days (07/15/11): 1. one copy of the completed "Return to Compliance Certification" form 2. a written corrective action statement for the above violation 3. one copy of the manifest signed by the designated facility confirming waste was received Notes: - In 2010 year, facility generated approx 3435 gallons (13.74 Tons) of used oil, 2040 gallons (8.16 Tons) of used antifreeze, 3.11 Tons of waste paint liquid/solids and oily sludge = 35.01 Tons of haz waste - Potential Universal Waste found: unused microwave found in break area of Service Department and a small television monitor found near the office of the Body Shop. Universal waste can remain stored onsite for up to one year of initial date of accumulation. Item must be labeled as "Universal Waste - electronic devices". Ensure items are taken to an authorized hazardous waste disposal facility and retain disposal receipt onsite for a minimum of 3 years. - Fluorescent tubes maintenance performed by outside contractor who takes waste tubes. - Provided free training schedule. Recommended courses: Universal waste, Hazardous waste, Basic Auto Industry Hazardous Waste Management, Spill Prevention Control & Countermeasure -Waste oil & antifreeze tank assessment last done 77.
