0 0 <br /> Response to Alleged Violations <br /> #11: Facility is not maintained to minimize the release of o hazardous waste. <br /> These items were listed as"wet oil stains around machines in the machine shop,crystallized waste in <br /> the secondary containment of the scrubber tank",oil in the secondary contain of a 55 gallon drum <br /> storing new oil,oil on the ground by the wax tank and dark damp areas in the field on the west side of <br /> the property". <br /> In the past the machine shop has used granular absorbent around machines were incidental oil <br /> accumulated.Since this inspection the machine shop began using"pig" mats around equipment in an <br /> effort to improve housekeeping and those mats will changed out as needed and disposed of as oily <br /> debris.The majority of the oil noted in the machine shop was accumulated in the machine catch trays <br /> that are designed specifically for that purpose.The cutting oil is necessary to safely operate this type of <br /> equipment and will always be present during any operation the machine shop. <br /> The crystallized "waste" referred to in the inspection report is not hazardous waste or a waste at all.The <br /> material is process water with a high nutrient value that is used in emissions control units and will <br /> crystallize over a short period of time.These basins are washed out regularly and washed into the <br /> contained sump system and reused in the plant in the manufacturing process.Therefore Simplot does <br /> not feel this is a violation. <br /> The oil in the secondary containment has been cleaned up and placed in a used oil container for <br /> disposal. In the future this area will be inspected more frequently and issues addressed promptly. <br /> The wax tank was cleaned and the rinsate was disposed of as oily water(manifest enclosed).Also <br /> numerous other areas in the plant were cleaned during this process. <br /> The"dark damp" areas located on the west side of the property are not believed to be hazardous waste <br /> or the result of spills of hazardous materials.The plant previously managed non-hazardous residues and <br /> tailings from phosphoric acid manufacture in these areas of the plant.The material handled was <br /> predominantly calcium sulfate (gypsum)and we believe that these salts in the soils give it a discolored <br /> appearance similar to oil-stained soil. Samples will betaken to verify the composition of the discolored <br /> soil.Once a determination is made action, if necessary, will be taken at that time. <br /> #18:Stared hazardous waste onsite longer than 90 days without a permit or authorization. <br /> This item was material stored in the lab and listed as 3 small bottles of waste and 1-5 gallon bucket of <br /> mercury waste.The 3 small bottles were determined to be active lab samples and not waste, those <br /> items were inadvertently placed in the waste storage area.The mercury waste was disposed of on <br /> 7/19/2010, see enclosed manifest. <br /> #20: Failed to completely label containers of hazardous waste. <br /> The following containers were observed in the lab storage area: 3-1 gallon containers of acetone waste, <br /> 3 small bottles of waste without a hazardous waste label and 1-5 gallon bucket with a small amount of <br /> mercury waste. <br /> As stated above the 3 small bottles were determined to not be waste material and were active lab <br /> samples.The acetone waste and mercury waste was disposed of on 7/19/2010, see enclosed manifest. <br />
