Conrady: <br /> I received an unexpected telephone call last week from <br /> Chuck Pomeroy, the attorney for American Savings regarding <br /> the Major Mart station. Since we had authorized them to <br /> proceed with investigation of the site, I had assumed they <br /> were doing so and expected an update of the process . In- <br /> stead, I was informed by Mr. Pomeroy that American Savings <br /> has decided not to proceed with any testing of the site and <br /> will in fact attempt to have the foreclosure sale "rescind- <br /> ed" . Apparently all actions of American must be reviewed and <br /> approved by the federal agency which is overseeing its reor- <br /> ganization, and this agency did not approve the expenditure <br /> of any funds on this site. As a follow up, I received the <br /> enclosed letter. <br /> American Savings has notified the San Joaquin Local <br /> health District of this fact, and the Health District has <br /> determined to turn the matter over to the District Attorney. <br /> I have spoken to the Health District and told them that we <br /> would be considering whether or not you would undertake the <br /> studies on your own and that we would let them know. I know <br /> the District Attorney to whom the matter is being referred, <br /> and I will be in contact with her when she is familiar with <br /> the case. <br /> At this point, I once again put to you the question <br /> which you have already answered once: Do you wish to proceed <br /> on your own with the testing on the site to be done by <br /> Leedshill-Herkenhoff at a cost of $13 , 800 . 00 so that you will <br /> have the information which you need to determine whether or <br />
