White staining was also noted inside the drainage ditch located north of <br /> the fertilizer tank's secondary containment. This ditch runs along the northern property boundary starting from the approxi- <br /> mate location of the fertilizer storage tank and continuing toward the northwestern property boundary. <br /> OBSERVATIONS: White staining was observed on bare soil in the northern portion of the property. Mr. Pallen stated that <br /> this staining is likely due to a fertilizer overspill, originated from the secondary containment during a water pipe rupture, <br /> which occurred 1-2 month ago. Hazardous wastes shall be disposed of only by transportation to a permitted hazardous <br /> waste treatment, storage, and disposal facility (TSDF). Immediately cease disposal of hazardous waste to ground sur- <br /> face, address all the waste spillage, and ensure that all future waste is hauled by a licensed hazardous waste transporter <br /> to a permitted TSDF. Submit proof of correction to the EHD. <br /> VIOLATIONS: <br /> ® Discharge of any Waste, including Sewage <br /> (CA Health and Safety Code 5411) <br /> ® Discharge of Waste or Sewage to Water or within 150' of Waterway <br /> (SJC Ordinance Code Section 9-1125.3, 9-1125.4) <br /> ® Improper Disposal of a Hazardous Waste <br /> (CA Health and Safety Code 25189.5) <br /> ❑ Other: <br /> CORRECTIVE ACTIONS/ORDER: <br /> Immediately contain, clean up, and dispose of the waste at an authorized, permitted location. <br /> Ensure that clean up personnel possess adequate training. <br /> ® Investigate and abate contamination under the oversight of the appropriate lead agency. <br /> ® Submit copies of hazardous waste manifests/disposal records to the EHD within 30 days. <br /> ® Other: address soil impact and drainage ditch impact Correct By: Immediately <br /> COST RECOVERY:All EHD Staff Time Associated with this Spill Response is Billed to the Responsible Party at <br /> the Current Hourly Rate.
