He said that that was fine. <br /> 11:45AM—Left the scene. <br /> 12:30PM—Called the County Agriculture Commissioner's office to make a referral. <br /> 2:30PM — Tom Reed from the County Agriculture Commissioner's office called to confirm <br /> details of the referral and to tell me that they would follow up on it. <br /> April 7. 200 <br /> 8:30AM — Called and left a message for Jim Allan with the SJC Agriculture Commissioner's <br /> office. <br /> April 11, 2000 <br /> Determined I had the wrong phone number for Jim Allan. I received the correct phone <br /> number and called him. He stated that he had not had a chance to verify the allegations with <br /> Mr. Kahler because they had not found a time to meet. He stated that they would be issuing <br /> the SJ River Club a Notice of Violation for the use of an unregistered pesticide (diesel fuel). He <br /> said that they would not be able to issue any worker safety violations, because the people who <br /> had applied it were volunteers. He said that he would send a copy of his report to me when it <br /> has been completed. <br /> Talked with Kasey Foley. She said to follow up with the SJ River Club to see if they intended to <br /> clean it up appropriately. <br /> April 12, 2000 <br /> Called Mr. Larry Kahler at the San Joaquin River Club and asked him what the status of the <br /> cleanup was. He stated that they had put the waste from the sprayer in containers and were <br /> going to take them to the household hazardous waste event in Tracy this month. I told him <br /> that he would also have to clean up any contaminated vegetation and soil,and that the cleanup <br /> would have to be done by individuals who have 40-hour HAZWOPER training. I asked him if <br /> he still had the list of hazardous waste haulers, and he said yes (it is at the office). I told him <br /> that he will need to contact one of those companies and arrange for cleanup. I told him that <br /> once cleanup is complete he could request permission to take that waste to a Household <br /> Hazardous Waste Collection event as well, or he could have the company haul it to an <br /> appropriate facility. He said that he was working with someone else about that. I confirmed <br /> that he was talking about Jim Allan. I told him that our agency is requiring cleanup, even if <br /> the Ag Commissioner does not. I told him that disposing of diesel to the ground is a Class I <br /> Violation. He said that the amount of diesel may not be detectable, because it was a small <br /> amount. I told him that any area that had been sprayed with the diesel would need to be <br /> cleaned up. The amount of diesel in the waste will only determine where the waste can be <br /> disposed of. He said that he would not be able to make a decision until the Board Meeting on <br /> Saturday (April 15, 2000). <br /> I told Mr. Kahler that I would need to come back out to the facility to conduct a routine <br /> hazardous waste inspection. He said that they did not want a hazardous waste permit. I told <br /> him that he would have to carry a permit until he ceased all hazardous waste operations at his <br /> maintenance facility. He said that they do not generate hazardous waste. I reminded Mr. <br /> Kahler that I had seen drums of used oil at the facility and that used oil is a hazardous waste. <br /> Mr. Kahler said that a lot of the waste in the yard has been there a long time. He said that I <br /> had told him that it depends on the amount of waste they have, and I told Mr. Kahler that I had <br /> never said that.
