i <br /> Chapter 8 Public Access and Trade Secrets <br /> 8.i Availability of Source Reduction Documents <br /> With the exception of the SPR, Plans and Reports are not sent to DTSC upon <br /> completion. However,a generator must keep a copy of the Plan,Report,and SPR at <br /> the generator's site and, upon request, present the documents to any authorized <br /> representative of DTSC or the local authorize agency conducting an inspection. The <br /> generator is subject to a fine of$1,000 per day for failure to provide any source <br /> reduction documents upon request. <br /> A copy of the Plan,Report,and SPR must be available locally for public review. <br /> The source reduction documents can be kept at the generator's site,a public library, <br /> or the office of a local governmental agency willing to act as a repository for the <br /> documents. <br /> 8.2 Protecting Trade Secrets <br /> A generator may claim any information submitted to DTSC under SB 14 as <br /> confidential. When DTSC requests a generator to submit a source reduction <br /> document containing confidential information,the generator must make a claim of <br /> confidentiality by placing the words "confidential business information" on each <br /> page containing the confidential information. If the generator does not make a claim <br /> of confidentiality, DTSC can make the information available to the public without <br /> notifying the generator. <br /> WhenDTSC requests a generator to submit a source reduction document containing <br /> confidential information, the generator must submit two versions of the document. <br /> One version must contain the confidential information. The generator must remove <br /> the confidential information from the second version and clearly indicate which <br /> pages have been removed. The generator is responsible for removing trade secrets <br /> from the documents before fulfilling the public's request to view the documents. <br /> 60 <br />
