MEMO <br />DATE: MAY 26, 1998 <br />TO: DAVID TREY, DEPUTY DISTRICT ATTORNEY <br />SAN JOAQUIN COUNTY OFFICE OF THE DISTRICT ATTORNEY <br />ENVIRONMENTAL PROSECUTIONS UNIT <br />FROM: ERIC REVENA, SENIOR R.E.H.S. <br />SAN JOAQUIN COUNTY PUBLIC HEALTH SERVICES <br />ENVIRONMENTAL HEALTH DIVISION <br />RE: E.F. MITCHLER, 851 E. LODI AVE., LODI, AND 641 S. HARRISON, STOCKTON. <br />The following items from the prior inspections have not been corrected. <br />851 E. LODI AVE. <br />#20: The letter dated January 26, 1998 from E.F. Mitchier does not indicate if the two <br />containers of oily waste were labeled correctly. <br />#11: The letter dated January 26, 1998 from E.F. Mitchler does not explain if an E.P.A. I.D. <br />number was obtained. <br />#45: A completed contingency plan explaining what actions facility personnel shall take in <br />response to fires, explosions, or any unplanned sudden or non -sudden release of <br />hazardous waste or hazardous waste constituents to air, soil, or surface water at the <br />facility was not submitted. <br />#49: Employee training records for the employees who managed hazardous waste were not <br />submitted to this office. <br />641 S. HARRISON <br />#75. A certification of return to complianse was not submitted to this office from the September <br />9, 1997 inspection. <br />#10: The waste characterization for the status of the contaminated absorbent was not <br />submitted to this office. <br />#20: The letter dated January 26, 1998 does not explain if the referenced containers of <br />hazardous waste were labeled correctly. <br />#21: The letter dated January 26, 1998 does not explain if the containers of hazardous waste <br />were kept in closed containers. <br />#27,& 30-33: The letter dated January 26, 1998 from E.F. Mitchler explained that all of the <br />waste oil, empty drums and used oil filters were hauled away be Evergreen <br />Environmental Services. There was no documentation submitted to verify that <br />the oil filters were disposed of properly. There were no copies of manifests for the <br />last three years submitted to this office. <br />
