<br />"Miscellaneous unit" means a hazardousote management unit where hazardous waste i� sferred, treated, stored, or disposed of
<br />and that is not a container, tank, surface impoundment, pile, land treatment unit, landfill, incinerator, boiler, industrial furnace other than
<br />industrial fumaces which are conditionally exempted pursuant to subsections (c) or (f) of section 66266.100, underground injection well
<br />with appropriate technical standards under article 5.5 commencing with section 25159.10 of chapter 6.5 of division 20 of the Health and
<br />Safety Code, containment building, corrective action management unit, or unit eligible for a research, development and demonstration
<br />permit under section 66270.65.
<br />"Monitoring parameter" means one of the set of parameters specified in the facility permit for which monitoring is conducted. Monitoring
<br />parameters shall include physical parameters, waste constituents, reaction products, and hazardous constituents, that provide a reliable
<br />indication of a release from a regulated unit.
<br />"Monitoring point' means a well, device or location specified in the facility permit at which the water quality or environmental protection
<br />standard applies and at which monitoring is conducted.
<br />"Movement" means that hazardous waste transported to a facility in an individual vehicle.
<br />"National Pollutant Discharge Elimination System" means the national program for issuing, modifying, revoking and reissuing,
<br />terminating, monitoring and enforcing permits, and imposing and enforcing pretreatment requirements, undersections 307, 318, 402,
<br />and 405 of the Federal Water Pollution Control Act (33 U.S.C. sections 1317,1328, 1342 and 1345). The term includes an approved
<br />program.
<br />"Natural resources" includes, but is not limited to, disposal site capacityand substances which are hazardous waste, orrh a�rraaa nnn
<br />hazardous waste, the reuse of which is technologically and economically feasible. C �: \ / `D
<br />"Net working capital" means current assets minus current liabilities. G V
<br />"Net worth" means total assets minus total liabilities and is equivalent to owners equity. AUG O 5 2014
<br />"New facility" see "New hazardous waste management facility."
<br />ENVIRONMENTAL HEALTH
<br />"New hazardous waste facility'see "New hazardous waste management facility." DEPARTMENT
<br />"New hazardous waste management facility," "new hazardous waste facility," or "new facility' means a facility which began operation, or
<br />for which construction commenced after November 19,1980.
<br />"New tank component" see "New tank system"
<br />"New tank system" or "new tank component" means a tank system or component that will be used for the transfer, storage or treatment of
<br />hazardous waste and for which installation (as defined under "Existing tank system" in this section) has commenced after the dates
<br />indicated below; except, however, for purposes of sections 66264.193(g) and 66265.193(g), a new tank system is one for which
<br />construction commences after the dates indicated below: (See also "Existing tank system")
<br />(a) July 14, 1986, for tanks containing RCRA hazardous wastes, unless:
<br />(1) the owner or operator is a conditionally exempt small quantity generator as defined in 40 CFR section 261.5, or a 100 to 1,000
<br />kg per month generator as defined in 40 CFR section 265.201, or
<br />(2) the owner or operator is not subject to regulation in 40 CFR part 264 or part 265 pursuant to an exemption in 40 CFR section
<br />264.1 or section 265.1;
<br />(b) July 1, 1991 for:
<br />(1) tanks containing only non-RCRA hazardous wastes, and
<br />(2) tanks containing RCRA hazardous wastes, if:
<br />(A) the owner oroperator is a conditionally exempt small quantity generator or a 100 to 1,000 kg per month generator, or
<br />(B) the owner or operator is not subject to regulation in 40 CFR part 264 or part265 pursuant to an exemption in 40 CFR section
<br />264.1 or section 265.1, but the owner or operator is subject to the standards of article 10 of chapter 14 or article 10 of chapter 15 of
<br />this division.
<br />"No detectable organic emissions" means no escape of organics to the atmosphere as determined using the procedure specified in
<br />section 66265.1084(d).
<br />"Non-RCRA hazardous waste" means all hazardous waste regulated in the State, other than RCRA hazardous waste as defined in this
<br />section. A hazardous waste is presumed to be a RCRA hazardous waste, unless it is determined pursuant to section 66261.101 that the
<br />hazardous waste is a non-RCRA hazardous waste.
<br />"Nonsudden accidental occurrence" means an unforeseen and unexpected accident which takes place overtime, involves continuous or
<br />repeated exposure and results in bodily injury, property damage or environmental degradation.
<br />"Nonwastewaters" means, for the purposes of chapter 18 of this division, wastes that do not meet the criteria for wastewaters found in the
<br />definition of "wastewaters" in this section.
