ARTICLE IV <br /> RESTRICTIONS AND ACCESS <br /> 4.01 Prohibited Use. The Property shall not be used in any way that may impede or <br /> interfere with the performance of any post closure activity or corrective action required for the <br /> Property, including the operation and maintenance of groundwater extraction and treatment <br /> system. <br /> 4.02 Prohibited Activities. <br /> (a) No Owner or Occupant shall e•tgage in any acti,.ity that may impede or <br /> interfere with the performance of any post closure activity or corrective action required for the <br /> Property, including the operation and maintenance of groundwater extraction and treatment <br /> system. <br /> (b) No groundwater shall be extracted on the Property for purposes other than <br /> post closure care activities or corrective action or construction dewatering. <br /> 4.03 Access. Covenantor agrees that the Department shall have reasonable right of entry <br /> and access to the Property for inspection, monitoring, and other activities consistent with the <br /> purposes of this Covenant and as deemed necessary by the Department in order to protect the <br /> environment or public health. Covenantor further agrees that the entity or person who has the <br /> responsibility to implement post closure care activities and corrective action at the Property shall <br /> have reasonable right of entry and access to the Property until such time as the Department <br /> determines that no further post closure care or corrective action is required. <br /> ARTICLE V <br /> ENFORCEMENT <br /> 5.01 Enforcement. Failure of the Covenantor and'or Owner to comply with any of the <br /> Restrictions specifically applicable to it shall be grounds for the Department,by reason of this <br /> Covenant, to require that the Covenantor and or Owner modify or remove any improvements <br /> ("Improvements" herein shall mean all buildings, reads,driveways, and paved parking areas, <br /> constructed or placed upon any portion of the Property constructed in violation of the <br /> Restrictions). Violation of this Covenant shall be grounds for the Department to file civil and'or <br /> criminal actions against the Covenantor an&or Owner as provided by law. <br /> Page 4 <br />
