WASTE DISCHARGE REQUIREMENTS FOR -7- <br /> KEARNEY-KPF <br /> CLOSURE OF SURFACE IMPOUNDMENTS <br /> SAN JOAQUIN COUNTY <br /> 41 . The Board has reviewed the Negative Declaration and concurs that there will <br /> be no significant impacts to water quality upon compliance with these waste <br /> discharge requirements (WDRs) . <br /> 42. The action to adopt WDRs for these waste management units is exempt from <br /> the provisions of he California Environmental Quality Act (CEQA) in <br /> accordance with Section 15301 , Title 14 of the California Code of <br /> Regulations (CCR) . <br /> OTHER LEGAL REFERENCES <br /> 43. The Water Quality Control Plan for the Sacramento - San Joaquin Delta (5B) <br /> was adopted on 25 July 1975. This order implements the water quality <br /> objectives stated in that Plan. Furthermore, this Order implements the <br /> prescriptive standards and performance goals of Subchapter 15, effective <br /> 27 November 1984. <br /> 44. All local agencies with jurisdiction to regulate land use, solid waste <br /> disposal , air pollution, and to protect public health have approved use of <br /> this site for the discharges of waste to land stated herein. <br /> 45. The Board has notified the Discharger, interested agencies and persons of <br /> its intention to issue the waste discharge requirements for this facility. <br /> 46. In a public hearing, the Board heard and considered all comments pertaining <br /> to this facility and discharge. <br /> IT IS HEREBY ORDERED that Kearney-KPF in order to meet the provisions of Division <br /> 7 of the California Water Code and the regulations adopted thereunder, shall <br /> comply with the following: <br /> A. PROVISIONS <br /> 1. The discharge of ' hazardous waste' at this facility is prohibited. <br /> The discharge of 'designated waste' at this facility, except for the <br /> discharge of septage and chemical toilet waste to the septic tanks <br /> and the discharge of drilling muds, cuttings and development and <br /> aquifer test waters from the remedial investigation to the field in <br /> the western portion of the facility, is prohibited. For the purpose <br /> of this Order, the terms ' hazardous waste' and 'designated waste' are <br /> as defined in Subchapter 15. <br />
