-3- <br /> 11. The Closure Plan does not provide for verification soil <br /> sampling. The Closure Plan shall provide that a verification <br /> Soil Sampling Plan will be developed and submitted to DHS for <br /> approval before commencing verification sampling. <br /> 12 . The Closure Plan must have a detailed written estimate, <br /> in current dollars, of the cost of closing the facility in <br /> accordance with the requirements in 40 CFR 265. 111 through <br /> 265. 115. <br /> 13 . All appropriate engineering drawings and illustrations <br /> should be drawn to scale, and so noted thereon. <br /> 14 . The Facility shall, within 60 days of certification of <br /> closure, record a notation on the property deed to the <br /> facility in accordance with 40 CFR 265. 119 (b) (1) and (2) for <br /> all four listed Alternatives. <br /> 15. If after characterization the facility selects one of the <br /> four closure alternatives which, in the opinion of DHS, does <br /> not offer sufficient protection to the public health and <br /> environment, DHS will select and or modify one of the other <br /> three closure alternatives as a closure plan which will offer <br /> sufficient protection. <br /> SPECIFIC COMMENTS <br /> The following comments are specific in nature and are listed <br /> by page occurrence. <br /> Section 1 - Introduction <br /> 1. Page 1, para 1, line 7 . This sentence should read, "This <br /> Closure Plan was prepared in accordance with the California <br /> Code of Regulations (CCR) , Title 22 (22CCR) of the Department <br /> of Health Services; Title 23 (23CCR) of the State Water <br /> Resources Control Board (SWRCB) ; and Title 40 of the Code of <br /> Federal Regulations (40 CFR) , Part 265, Subparts G and K. <br /> 2 . Page 1, para 2 . This paragraph needs to be revised. <br /> Detailed Closure costs shall be estimated. Title 40 CFR <br /> 265. 142 (a) states, "The owner or operator must have a <br /> detailed written estimate, in current dollars, of the cost of <br /> closing the facility in accordance with the requirements in <br /> 265. 111 through 265. 115. " <br /> 3 . Page 1, para 2 . Financial Assurance and Liability <br /> Statement should be a separate section within the Closure <br /> Plan. <br />
