Regs. , <br /> Section 265 . 90 (a) , in that on or about December 6 <br /> and 7 , 1988, Kearney-KPF failed to implement a <br /> ground water monitoring program capable of <br /> determining the facility's impact on the quality <br /> of ground water in the uppermost aquifer <br /> underlying the facility. Kearney-KPF failed to <br /> prepare or augment hydrogeologic cross-sections as <br /> additional wells have been installed. Submitted <br /> sections have not depicted screened intervals and <br /> a representative ground water level for each well . <br /> 4 . Title 4u, Code of 1,: 1�'.y.=.. , .5 s,& <br /> 265. 93 (d) (4) . <br /> Kearney-KPF violated Title 40, Code of Fed. Regs. , <br /> Section 265 .93 (d) (4) , in that on or about December <br /> 6 and 7 , 1988, Kearney-KPF failed to implement a <br /> ground water quality assessment plan which would <br /> determine the extent of migration and <br /> concentration of hazardous waste or hazardous <br /> waste constituents in the ground water. The <br /> facility has failed to adequately monitor Pond 1 <br /> in the upper water-bearing zone. Also, the <br /> facility has failed to monitor the interval <br /> between approximately 70 to 180 feet in depth. <br /> Additionally, the lower water-bearing zone (180 to <br /> 220 feet) is inadequately monitored. <br /> 5. Title 40, Code of Fed. Regs. , Section <br /> 265.93 (d) (4) . <br /> Kearney-KPF violated Title 40, Code of Fed. Regs. , <br /> Section 265. 93 (d) (4) , in that on or about December <br /> 6 and 7 , 1988, Kearney-KPF failed to implement a <br /> ground water quality assessment pian wnich would <br /> determine the rate of migration and concentration <br /> of hazardous waste or hazardous waste constituents <br /> in the ground water. The facility failed to make <br /> a sufficient number of hydraulic conductivity (K) <br /> determinations. <br /> 6. Title 40, Code of Fed. Regs. , Section <br /> 265. 93 (d) (7) (i) . <br /> Kearney-KPF violated Title 40, Code of Fed. Regs. , <br /> Section 265. 93 (d) (7) (i) , in that on or about <br /> December 6 and 7, 1989, Kearney-KPF failed to <br /> collect consistent and complete quarterly <br /> historical ground water monitoring data. <br /> Kearney-KPF failed to make determinations of the <br /> rate and extent of migration and concentration of <br />
