Donovan
Page 2
August 21, 1987
requires the Department to actively "seek full reimbursement
for projected expenses associated with monitoring hazardous
waste mitigation projects operated under an agreement with
responsible parties prior to initiation of such activities" .
Enclosed is a memorandum which details our estimated costs for
a one year period.
If you as a responsible party wish to be considered cooperative
with the Department's remediation activities at the Kearney-KPF
site, you will sign the Stipulation or negotiate with the
Department and sign a modified Stipulation within 30 calendar
days from issuance of this letter. If you do not stipulate to
the Order, the Department will recover costs incurred through
civil action by the State Attorney General in accordance with
H&SC Section 25360.
After 15 calendar days from the issuance of this letter, the
Department will sign the attached Order and its requirements
and schedule will be in effect. The Order sets forth various
compliance dates. These dates are
contingent
effective date of the Order and areasfollows: the
(1) within 10 days, submit the name of the project
coordinator and the project registered engineer or
geologist;
(2) within 30 days (a) submit the RI/FS workplan and (b)
submit the initial monthly report.
If you do not comply with the requirements of the Order, the
Department itself will proceed to investigate and remediate the
site in accordance with H&SC Section 25355. 5 and recover its
costs from responsible parties in accordance with H&SC Section
25360.
Because the Department has set forth and intends to enforce
tight time schedules for the negotiation of the Sitpulation and
initiation of the work described in the Order, we suggest that
You immediately contact us to set a meeting date to discuss
these issues.
