JUL 01 2016 <br /> THE WINE GROUP P.C%404►�_ ' <br /> Return to Compliance <br /> TO: Elena Manzo/Environmental Health Department <br /> FROM: Chuck Mitten/The Wine Group <br /> DATE: 6/30/2016 <br /> Below is a summary of each notice to comply (with associated line number)followed by The Wine <br /> Group's response on actions taken to return to compliance: <br /> Notice to Comply (Item#102): CCR 66262.11, 66262.40(c)Failed to determine if a waste is a <br /> hazardous waste or retain waste analysis on site for 3 years. <br /> 1)According to Mr. Mark McPherson,oily metal fines (metal fines commingled with the lubricating <br /> fluids),generated from the wet metal cutting saw located in the maintenance shop,are being recycled as <br /> scrap metal without first determining particle size or hazardous properties.Any person who generates a <br /> waste shall determine if the waste is a hazardous waste. Immediately stop recycling metal fines, make a <br /> hazardous waste determination for these oily metal fines, and manage them according to Title 22 <br /> hazardous waste regulations. Particles 100 microns or smaller must be handled as hazardous waste if the <br /> metal is determined to be a hazardous waste. Submit a statement and <br /> supporting documentation explaining how this waste was managed. <br /> 2)One 55-gallon metal container with some liquid, labeled as "methanol",was noted next to the S02 <br /> storage area. Mr. McPherson indicated that it looked like water and not the methanol, and he is not sure <br /> what it was.Any person who generates a waste shall determine if the waste is a hazardous waste. <br /> Immediately make a hazardous waste determination for this waste,and manage it according the Title 22 <br /> hazardous waste regulations. Submit a statement and supporting documentation explaining how this waste <br /> was managed. <br /> 3)Copper colored material was noted on the ground in the outdoor storage area, located next to the <br /> hazardous waste storage area; the spilled material covered an area of approximately 5x2 feet.
