Notice to Comply - Minor violations: 452 No emergency coordinator; No modified contingency plan, Failed to train all employees on waste handling and emergency procedures. No emergency coordinator was identified on site. A contingency plan could not be located on site; no modified contingency plan was posted. Per employees on site at time of inspection, facility does not conduct training in hazardous waste handling and emergency procedures. Employees were unfamiliar with hazardous waste requirements and spill handling. At all times there must be at least one employee either on the premises or on call (available to respond to an emergency by reaching the facility within a short period of time) with the responsibility for coordinating all emergency response measures, titled the Emergency Coordinator. The following information must be posted near a telephone: name & telephone of the emergency coordinator, location of all fire extinguishers, fire alarms & spill control equipment, the telephone number for the fire department. All employees shall be thoroughly familiar with proper hazardous waste handling and emergency procedures. Immediately designate an emergency coordinator for this facility, post the required emergency information (modified contingency plan) near a telephone, and train employees in all necessary hazardous waste handling and emergency procedures. Submit a copy of the posted modified contingency plan to the EHD within 30 days (8/9/10). Complete & submit a copy of the Return to Compliance Certification to the EHD within 30 days (8/9/10) along with any supporting paperwork and a statement documenting the corrective actions that have been or will be taken for each violation. Notes: - Per assistant manager, facility opened in November 2009 and no hazardous waste has been generated at this facility since that time. Absorbent and waste containers are available on site, however, spent absorbent from spill cleanup may not be handled properly. Ensure that all hazardous waste contaminated absorbent is being handled properly as a hazardous waste. - Disposal receipts for all hazardous wastes must be maintained on site for at least three years, including records for universal waste disposal (fluorescent bulbs, alkaline batteries, electronics, etc.). Provided: Modified contingency plan template, Sample label, Hazardous waste labels, Training schedule of free classes ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE($116).
