Mr. Michael Gathercoal <br /> Page 2 <br /> Based on the above information and pursuant to Section 25143 of the <br /> Health and Safety Code and Section 66310 of Title 22 , (CCR) , DHS <br /> concludes that the sand blast/soil waste is insignificant as a <br /> potential hazard to human health and safety, livestock or wildlife <br /> because of its small quantity, low concentration or physical or <br /> chemical characteristics. <br /> Accordingly you are granted a variance from the manifest <br /> requirements of Title 22 , CCR, subject to the following conditions: <br /> o This variance applies only to the sand blast/soil waste. <br /> o The sand blast/soil is to be transported back to Union Pacific <br /> Resources, the original manufacturer, for recycling. <br /> 0 The above-mentioned hazardous waste shall be transported in <br /> accordance with the Vehicle Code, the regulations of the <br /> California Highway Patrol (Title 13, CCR) , the regulations of <br /> the Department of Transportation (Title 49 , Code of Federal <br /> Regulations) . <br /> o Copies of shipping documents are to be sent to DHS, 4250 Power <br /> Inn Road, Sacramento, CA 95826, Attention: Joseph Franz . <br /> o The company shall keep copies of shipping documents for a <br /> period of three years following termination of this project. <br /> o A copy of this variance will be carried in the vehicle used to <br /> transport the sand blast/soil . <br /> This variance may be cancelled by DHS at any time and shall expire <br /> when the project is complete or by May 1, 1989, whichever comes <br /> first. <br /> If you require further information about this matter, please <br /> contact Theresa McGarry of my staff at (916) 324-2428 . <br /> Sincerely, <br /> Llo Batham <br /> Surveillance and Enforcement <br /> Toxic Substances Control Division <br /> cc: See next page <br />
