The inspector observed the oil <br /> water separatorinear the painting area;with a truck parked over it and a hose coming out of it. <br /> According to Bob Woolsey the oil water separator has not been used since 2003. The separator was <br /> full of a dark oily liquid. According to Marty, painter, he sometimes has to pump out the liquid in the <br /> separator when it rains because he gets flooded out. The collection sump is considered an <br /> underground storage tank as defined by California Health and Safety Code Section 25281(y)(1). <br /> Violation: <br /> California Health and Safety Code Section 25284(a)(1)— Except as provided in subdivision (c), no <br /> person may own or operate an underground storage tank unless a permit for its operation has been <br /> issued by the local agency to the owner or operator of the tank. <br /> Corrective Action: <br /> Immediately stop storing oily waste in the unpermitted UST. Remove the oily waste and <br /> dispose of as specified in Title 22 California Code of Regulations. <br /> In order to continue to use the oil water separator, demonstrate that separator is in compliance <br /> with the California Health and Safety Code and Title 23 California Code of Regulations. Please <br /> be advised that failure to comply with the above noted corrective action may result in further legal <br /> action.
