• • Intechra In'" CERTIFICATE OF INDEMNIFICATION FOR DATA DESTRUCTION AND RECYCLING MANIFEST NUMBER: 74073 (See ADR's on"Units"tab) Carleina Fournier 1920 Lyell Avenue DATE RECEIVED: 12/05/07 Rochester, NY, 14606 This Letter of Certification is provided to P032/PICS TELECOM CORPORATION (the "Customer")as assurance of the destruction/recycling or the erasure of data from software and electronic storage devices and/or the destruction and recycling of electronic equipment or components in connection with the Manifest number listed above and under the terms and conditions of Customers written agreement("Agreement")with Intechra LLC("Intechra"). Data Erasure and Software Destruction Intechra acknowledges receipt of the Material listed on the Manifest number above. For equipment and Material that will be destroyed or recycled, Intechra certifies that all non- functioning data storage devices have been or will be destroyed making it impossible to recover any data from the device and will be handled in accordance with applicable Federal, State,and Local laws and regulations. Intechra further acknowledges that all data on functional storage devices has been or will be erased according to Department of Defense 5220.22M standards or according to the method agreed to in writing with the Customer. Material Destruction and Recycling Intechra certifies that all Material listed on the above manifest number and marked for destruction and/or recycling has been or will be destroyed and recycled or otherwise disposed of in accordance with applicable Federal, State and Local laws and regulations. Indemnification Intechra will indemnify,defend and hold harmless the Customer, in the manner described and as set forth in the Customers written Agreement with Intechra,from removal or remediation costs,expenses and/or liabilities under the Comprehensive and Environmental Response, Compensation and Liability Act,42 U.S. Sec.9601, et seq.,and/or other laws stated in the Agreement, arising from the disposition of Materials obtained from the Customer under the above Manifest number. Additionally, Intechra will indemnify, defend and hold harmless the Customer, in the manner described and as set forth in the Customers written Agreement with Intechra,from costs,expenses and/or liability that may arise from any validated claim of recovered data or software improperly distributed due to Intechra's resale or destruction of the Material(s)obtained from the Customer under the above Manifest number. This indemnification shall not apply with respect to any liability or expense arising in conjunction with any Material provided by the Customer to Intechra that is not authorized under the Agreement.
