Failed to maintain spill control equipment and failed to keep containers of hazardous waste <br />closed except when adding or removing waste. Secondary containment for the five 55 gallon drums <br />located outdoors adjacent to the fire pump house was more than half full of oily -water. Secondary <br />containment was exposed to the rainy elements. Purpose of secondary containment is to hold chemical <br />spillage should its primary containment fail. If hazardous waste container is stored outdoors, it must be <br />kept closed at all times unless adding or removing waste to above spillage of contents to the soil and <br />environment. Immediately maintain the secondary containment dry and empty to maintain the purpose of <br />spill control equipment. If the secondary containment stores hazardous waste, container must be kept <br />closed and properly labeled and identifiable at all times unless adding or removing waste. <br /># 23. Failed to label "Drained Used Oil Filters" on one 55 gallon drum with an initial date of <br />accumulation. One 55 gallon drum with no label of any sort was located inside the shop nearby the two <br />55 gallon drums properly labeled "Drained Used Oil Filters" with an initial start accumulation date. Used <br />oil filters must be stored in a closed, rainproof container, labeled as "drained used oil filters," and marked <br />with an accumulation start date. Immediately ensure that all used oil filters are managed in this way. <br /># 50. Stored hazardous waste onsite longer than 180 days. One 55 gallon black metal drum of oily -solid <br />with a proper hazardous waste label had a start accumulation date of 04/25/2007. Facilities who <br />generate less than 1000 kg of hazardous waste per month and do not exceed 6000 kg of waste stored <br />on site at any time may store waste on site up to 180 days. Immediately contact a licensed hazardous <br />waste hauler to dispose of this waste under manifest and submit a copy of the manifest to the EHD by <br />02/21/2011. <br />Submit to SJC EHD within 30 days (02/21/2011): <br />1. one copy of the "Return to Compliance Certification" form <br />2. a written corrective action statement of the above violations <br />3. requested/ supporting documents, ie. disposal manifest receipts <br />Notes: <br />- Generated approximately 750 gallons (parts washer (ACT), used oil (Asbury))= 3 tons of hazardous <br />waste in 2010 year <br />- provided free training course schedule for 2011.
