REPUBLIC <br /> SERVICES, INC <br /> CONTRACT FOR LANDFILL SERVICES <br /> This Contract is entered into by and between Vasco Road Landfill and Temple Inland,Temple Inland desires to <br /> contract for landfill services to dispose of Ink filter press cakes from a property at 400 W.Valpico Road, <br /> TRACY. Vasco Road Landfill desires to provide to Temple Inland landfill services. In consideration of the <br /> following mutual covenants,the parties agree as follows: <br /> 1. Vasco Road Landfill agrees to provide landfill disposal services for Ink fitter press cakes from the property <br /> of 400 W.Valpico Road,TRACY only.Vasco Road Landfill is not responsible for providing any services other <br /> than those specified herein. <br /> 2. Temple Inland agrees to compensate Vasco Road Landfill for the landfill services as follows: Temple inland <br /> shall pay a disposal fee of$49.90 per ton, $4.53 per ton Out of County Tax, the environmental fee and a <br /> Fuel Recovery Fee implemented at this facility. All of the foregoing compensation is considered due <br /> immediately upon acceptance by Vasco Road Landfill of waste material for transport and/or storage. On any <br /> balance that Is 30 or more days overdue, interest shall accrue at monthly rate of one and one-half percent <br /> (1.50/6), with a$5.00 minimum, until paid in full. if at anytime any amounts are 30 or more days overdue, <br /> Vasco Road Landfill shall have the right to suspend its further performance under this agreement until payment <br /> in full is received. The environmental fee is subject to change. <br /> 3. This agreement shall not be binding on Vasco Road Landfill and no waste will be accepted by Vasco Road <br /> Landfill under this agreement until a signed copy of this agreement has been faxed to Vasco Road Landfill at <br /> (209)466-1067, or by such other means as Vasco Road Landfill may hereafter specify in writing. If customer <br /> does not provide a signed copy of this agreement to Vasco Road Landfill wlthln15 days of the agreement being <br /> signed by Vasco Road Landfill, the offer of Vasco Road Landfill to enter into this agreement shall be deemed <br /> revoked. This agreement shall remain in effect until October 12,2012. The termination of this agreement <br /> shall not affect the obligation of Vasco Road Landfill or the personal guarantor to pay amounts due under this <br /> agreement. <br /> 4. Each load of waste material must be accompanied by a manifest that specifically identifies the property from <br /> which the waste material derives_ The approval number assigned to Temple Inland for the project shall be <br /> used by Temple inland on all documentation and correspondence. The approval number assigned to Temple <br /> Inland for this project is: 385©Y915129. Vasco Road Landfill shall have the right, in its sole discretion,to reject <br /> any loads not complying with the documentation requirements.
