1 resulting from acts or omissions by UHC or their respective officers; directors, employees, <br /> 2 agents,representatives, contractors, successors, or assigns,in carrying out activities pursuant to <br /> 3 this Consent Judgment,nor shall the People be held as a party to or guarantor of any contract <br /> 4 entered into by UHC or their respective officers, directors, employees, agents,representatives, <br /> 5 contractors, successors, or assigns, in carrying out the requirements of this Consent Judgment. <br /> 6 M. NO WAIVER OF RIGHT TO ENFORCE <br /> 7 1 The failure of the People to enforce any provision of this Consent Judgment shall <br /> 8 neither be deemed a waiver of such provision,nor in any way affect the validity of this Consent <br /> 9 Judgment. The failure of the People to enforce any such provision shall not preclude it from <br /> 10 later enforcing the same or other provisions of the Consent Judgment. No oral advice, guidance, <br /> 11 1 suggestions, or comments by employees or officials of the People or UHC, or people or entities <br /> 12 acting on behalf of UHC,regarding matters covered in this Consent Judgment shall be construed <br /> 13 to relieve UHC of its Obligations under this Consent Judgment, <br /> 14 N. REGULATORY CHANGES <br /> 15 1. Nothing-in this Consent Judgment shall excuse UHC from meeting any more <br /> 16 stringent requirements that may be imposed by changes in applicable law. <br /> 17 O. APPLICATION OF CONSENT JUDGMENT <br /> 18 1. This Consent Judgment shall apply to and be binding upon the People and upon <br /> 19 UHC,and upon its successors and assigns. <br /> 20 P. AUTHORITY TO ENTER INTO STIPULATION <br /> 21 1. Each signatory to the Consent Judgment certifies that he or she is fully,authorized <br /> 22 by the party he or she represents to enter into this Consent Judgment, to execute it on behalf of <br /> 23 the party represented and to legally bind that party. <br /> 24 Q. CONTINUING JURISDICTION <br /> 25 1. The signatories to this Consent Judgment agree that this Court has continuing <br /> 26 jurisdiction to interpret and enforce this Consent Judgment. The Court shall retain continuing <br /> 27 jurisdiction to enforce the terms of the Consent Judgment and to address any other matters <br /> 28 arising out of or regarding this Consent Judgment.
