The report dated January 2, 1996 is on site. Briggs flagged file for July 10, 1997 and re-flagged it <br /> for precision test results to August 20, 1997. <br /> August 1, 1997 <br /> Briggs received passing precision test results from waste oil tank test. Briggs updated the <br /> compliance sheet. The site is in permit compliance. <br /> December 1, 1997 <br /> Don Nathe reviewed the file. <br /> December 1, 1998 <br /> Briggs received a phone call from Lopez who stated Nathe would not cooperate on the LIST <br /> removal requirement. Briggs phoned Nathe, got a recording, then the phone was hung up. <br /> December 3, 1998 <br /> Doug Wilson called Ray Lopez and told him that he would need to submit a Closure Plan and <br /> clean the tank. Mr. Lopez stated he was seeing his attorney tomorrow and would probably have <br /> to pay for the removal himself. <br /> December 9, 1998 <br /> Briggs received the Closure Plan from Thorpe Oil. <br /> December 14, 1998 <br /> Briggs reviewed the Closure Plan and conditionally approved it. <br /> January 22, 1999 <br /> Briggs witnessed one 1,000 gallon waste oil tank removal. <br /> Briggs wrote the following on the Removal Inspection Report"During removal, pipe running to lube <br /> racks was discovered. There was no equipment available to sample (under the piping on site). <br /> The closure is incomplete the piping must be sampled and grouted before closure is complete." <br /> May 28, 1999 <br /> Briggs reviewed the soil sample results and performed the Leaching Potential Analysis. Some of <br /> the results are missing including: Tank "North" no PCB's, stockpile no PCB's, Tank "North" & <br /> "South" no diesel. Briggs called Rich Thorpe; he was not in and will call back. <br /> June 8, 1999 <br /> Briggs completed the January 22, 1999 Closure Report with remote piping sampling compliance <br /> date of June 30, 1999. Mailed copy of January 22, 1999 Closure Report to owner and operator. <br /> June 9, 1999 <br /> Filed copies of certifications received. <br /> August 12, 1999 <br /> Briggs received a copy of sections XV and XVI from the lease agreement between Don Nathe, <br /> property owner, and Ray Lopez, lessee. Because the EHD does not handle enforcement of <br /> leases, and in order to obtain compliance with H&SC Chapter 6.7 Section 25298 (a}-(c), Briggs <br /> requested an Administrative Hearing be held to inform both property owner and lessee of their <br /> responsibilities. <br /> Briggs completed Notice of Administrative Hearing for Mr. Nathe and Mr. Lopez. Briggs submitted <br /> the notice to Kasey Foley, Lead Senior REHS. <br /> September 20, 1999 <br /> Briggs received a phone call from Ray Lopez concerning the site status. Briggs followed up by <br /> talking to Kasey Foley and Doug Wilson, who both told Briggs this is a legal matter and a D.A. <br /> referral should be written. <br /> 5 <br />
