FOLEY sanitarian Re: MAJOR MART GAS STATION 1235 East Alpine Road Stockton, California Dear Ms. Foley: This letter is to bring you up to date as to American Savings Bank's activities in connection with the property. By way of background, I need to point out to you that American Savings Bank arises out of a reorganization of a previously bankrupted American Savings and Loan. The present bank is basically operating under the jurisdiction of FSLIC of the Federal Government in connection with its reorganization. We are presently seeking authority to file an action to rescind the acquisition by foreclosure of the Major Mart property. At the time American foreclosed on the property, it had no knowledge of the contamination on the site which was left there by the prior owners and operators. Our problem in connecting any activities on the site is that we first need FSLIC approval. Secondly, the prior owner and operator for many years, Marjorie Conrady, holds a First Deed to Trust on the property in an amount which equals or exceeds the equity in the property. Since American Savings is under reorganization and Federal supervision, it is difficult to obtained permission to proceed to spend money of a bankrupt organization on property where there is no equity. We have been attempting to negotiate some workable arrangement with Marjorie Conrady and her attorney, Jeanne M. Zolezzi of the firm of Neumiller & Beardslee located at Fifth Floor Waterfront Office Tower II, 509 West Weber Avenue, Stockton, California
