Aurora <br /> Stockton CA <br /> (Former Safeway Facility #7753) <br /> Dear Ms. Cotulla: <br /> Safeway sold an industrial facility at 1320 S. Aurora in <br /> Stockton to Amana Enterprises in 1986. Amana's tenant recently <br /> informed Safeway that the local health district requires <br /> removal of an underground tank at the facility. I understand <br /> that an underground tank removal plan must be filed by 15 March <br /> 88. <br /> Safeway has reason to believe that the tank was abandoned, <br /> filled with sand and paved over with concrete at least as far <br /> back as 1976. It is my understanding that an underground tank <br /> so abandoned before 1984 is not covered by the regulations <br /> requiring removal and need not be removed. I do not ask you to <br /> agree with that view at this time. I merely want to explain <br /> that I think there is a possibility that the tank may not need <br /> to be removed. <br /> If removal of the tank is required, Safeway may well be <br /> responsible for the cost even though it is no longer the owner <br /> of the property and tank. To cooperate with the local health <br /> district, Safeway wishes to submit the underground tank removal <br /> plan set forth below. <br /> If removal of the tank is not required, Safeway' s <br /> submission of an underground tank removal plan is without <br /> prejudice to the right of any party, including Safeway, to <br /> object to having to remove the tank and to withdraw the plan. <br /> UNDERGROUND TANK REMOVAL PLAN <br /> 1.
