1 3. Defendant with actual or constructive knowledge of this Injunction, only in so far as they <br /> 2 are doing business in the State of California, in the course of Defendant's SERVICE STATION <br /> 3 activities, are pursuant to Health and Safety Code section 25100 et seq.,hereby permanently enjoined <br /> 4 from: <br /> 5 a. Violation of Health and Safety Code section 25160.2(b)(3), failing to maintain <br /> 6 manifests for at least three years; <br /> 7 b. Violation of Health and Safety Code section 25189.5(a), disposing or causing the <br /> 8 disposal of hazardous waste at a facility not permitted or at a point which is not authorized; <br /> 9 c. Violation of Califon-iia Code of Regulations, title 22 section 66262.11, failing to <br /> 10 determine if that waste is a hazardous waste; <br /> 11 d. Violation of California Code of Regulations, title 22 section 66262.34(d), storing <br /> 12 hazardous waste on site greater than 180 days; <br /> 13 e. Violation of California Code of Regulations,title 22 section 66262.34(f), failing to <br /> 14 label or mark containers used for onsite accumulation of hazardous waste; <br /> 15 f. Violation of California Code of Regulations, title 22 section 66265.3 1, failing to <br /> 16 maintain and operate facility to minimize the possibility of a fire, explosion, or any unplanned sudden <br /> 17 or non-sudden release of hazardous waste; <br /> 18 g. Violation of California Code of Regulations, title 22 section 66266.130(a), failing <br /> 19 to manage waste fuel filters as hazardous waste; <br /> 20 h. Violation of California Code of Regulations, title 22 section 66273.33(b)(1), failing <br /> 21 to manage universal waste lamps in a way that prevents releases of any universal waste or component <br /> 22 of a universal waste to the environment; and <br /> 23 i. Violation of California Code of Regulations, title 22 section 66273.35(b), failing to <br /> 24 demonstrate the length of time that the universal waste has been accumulated from the date it became <br /> 25 a waste; <br /> 26 4. Defendant with actual or constructive knowledge of this Injunction, only in so far as they <br /> 27 are doing business in the State of California, in the course of Defendant's SERVICE STATION <br /> 28 <br /> 2 <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT <br />
