1 1. Violation of California Code of Regulations, title 23 section 2650, failing to <br /> 2 properly record any unauthorized release of hazardous substances; <br /> 3 m. Violation of California Code of Regulations, title 23 section 2711(b), failing to <br /> 4 maintain current information on file with the local agency of any changes of information; <br /> 5 n. Violation of California Code of Regulations, title 23 section 2712(b), failing to <br /> 6 maintain written monitoring and maintenance records on-site; and <br /> 7 o. Violation of California Code of Regulations, title 23 section 2712(i), failing to <br /> 8 retain a copy of the permit and all conditions and attachments, including monitoring plans at the <br /> 9 facility. <br /> 10 5. Defendant with actual or constructive knowledge of this Injunction, only in so far as they <br /> 1 l are doing business in the State of California, in the course of Defendant's SERVICE STATION <br /> 12 activities, are pursuant to Business and Professions Code § 17204 hereby permanently enjoined from: <br /> 13 a. Violation of Health and Safety Code section 25100 et seq. described in paragraph <br /> 14 3 -3i above. <br /> 15 b. Violation of Health and Safety Code section 25280 et seq. described in paragraph <br /> 16 4-4o above; <br /> 17 6. Defendants shall pay to Plaintiff the sum of EIGHTEEN THOUSAND TWO HUNDRED <br /> 18 FIFTY DOLLARS ($18,250.00), as and for civil penalties,pursuant to Business and Professions <br /> 19 Code section 17206. Said payments shall be made payable to the TREASURER OF SAN JOAQUIN <br /> 20 COUNTY and delivered to the San Joaquin County Office of the District Attorney, Environmental <br /> 21 Prosecutions Unit, ON OR BEFORE JANUARY 15,2018. <br /> 22 7. Defendants shall pay to Plaintiff the sum of EIGHTEEN THOUSAND TWO HUNDRED <br /> 23 FIFTY DOLLARS ($18,250.00), as and for civil penalties,pursuant to Health and Safety Code <br /> 24 §25299. Said payment shall be made payable to the SAN JOAQUIN COUNTY <br /> 25 ENVIRONMENTAL HEALTH DEPARTMENT- ENVIRONMENTAL HEALTH DIVISION <br /> 26 TRUST. Said payments shall be delivered to the San Joaquin County Office of the District Attorney, <br /> 27 Environmental Prosecutions Unit, ON OR BEFORE JANUARY 15, 2017. <br /> 28 <br /> 4 <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT <br />
