Charter Way, Stockton Program: UST SUMMARY OF VIOLATIONS CLASS I,CLASS II,or MINOR-Notice to Com ROUTINE ANNUAL INSPECTION AND MONITORING SYSTEM CERTIFICATION Violations: (6, 7, 23c) 6, 7, 23c. A copy of the current approved monitoring and response plans were not found on site. A copy of the UST operating permit was not found on site. Maintenance and monitoring records were not found on site. The designated operator monthly inspection reports were not found on site. According to the owner, the binder containing all of the paperwork for this facility was stolen from the store while it was under construction. These records shall be kept on site for at least 3 years. The monitoring and response plans must be current and approved by the EHD with a copy maintained on site at the facility. A copy of the UST operating permit and all attachments and conditions shall be retained at the facility. Designated operator monthly inspection reports for the previous twelve months shall be retained on site. Immediately obtain a copy of the permit and retain it on site. Ensure that all of these documents are maintained securely on site at all times in the future. Complete and submit a copy of the Return to Compliance Certification to the EHD by June 30, 2011 along with a statement documenting the corrective actions that have been or will be taken for each violation and any supporting paperwork. "The facility is still shut down for repairs under SR0056531. The diesel turbine was not functioning at the time of inspection. The leak detectors could not be tested due to excess air in the lines. A reinspection will be required to test the diesel STP sensor, the sensors in the UDCs for the two diesel dispensers, and the leak detectors. All EHD staff time associated with the reinspection will be billed at the current hourly rate ($122). Note: Financial responsibility documents and updated tank forms for the conversion of the 89 tank to 87 and of the 87 tank to diesel were completed and submitted at the time of inspection. Per the owner's request, copies of the facility form, tank form, financial responsibility documents, monitoring & response plans, and designated operator statement will be mailed to the facility for their records.
