UNOCAL'S OBLIGATIONS TO RENEW CONTRACTS "PURSU,ANT <br />TO SECTION 102 OF THE FEDERAL "PETROLEUM MARKETING PRACTICES <br />ACT" ENACTED JUNE 19, 1978 00 NOT APPLY TO THIS TRIAL RETAIL <br />DEALER MOTOR FUEL PURCHASE CONTRACT. <br />THIS CONTRACT, made June 10 19 87 , between <br />UNION OIL COMPANY OF CALIFORNIA, d a UNOCAL, hereinafter called <br />"Unocal", and FRED HAMMOND AND CAROLYN HAMMOND <br />hereinafter called Dealer ; <br />The provisions of this Retail Dealer Motor Fuel Purchase <br />Contract are set forth in the "Recitals" and "Terms and <br />Conditions". <br />RECITALS <br />A. Unocal and Dealer agree that the successful operation of <br />an automotive service station (Station) depends on the ability <br />of the parties to generate customer acceptance of products and <br />services. The responsibility for acceptance of Unocal's <br />products is primarily Unocal's, through its development of good <br />quality merchandise available for purchase and resale by <br />Dealer, and the responsibility to develop and retain service <br />acceptance, to supplement product acceptance is primarily <br />Dealer's. Service acceptance is generated through courteous, <br />convenient and efficient customer service; the maintenance of a <br />clean, neat and orderly run business establishment; the <br />adherence to regularly scheduled hours of operation; Dealer's <br />personal attention to the operation of the station; fair and <br />honest selling techniques; and the maintenance of a complete <br />inventory of good quality merchandise to serve adequately and <br />quickly the needs and desires of customers. <br />B. Unocal has expended substantial amounts of time, money and <br />expertise in developing quality credit programs and quality <br />merchandise to be sold under its trade names and trademarks <br />(Marks). Dealer may use said Marks and credit programs in the <br />resale of Unocal branded merchandise; therefore, Dealer agrees <br />to render the type of courteous, convenient and efficient <br />service that will maintain the integrity and good reputation <br />which said Marks and credit programs have attained. <br />-1- <br />Form 3-4HO2W (Rev. 5/86) Printed in U.S.A. <br />
