El Dorado Street, Stockton <br /> The three underground storage tanks discovered on March 19, 2001 at the above-referenced location <br /> continue to be in violation of the Health and Safety Code (HSC) and Title 23 of the California Code <br /> of Regulations (CCR). <br /> In your letter dated June 11, 2001, you stated that Shell Oil told you that the three tanks at this <br /> location were legally and properly closed. It is not the responsibility of the San Joaquin County <br /> Environmental Health Division (EHD)to be involved in your dealings with Shell Oil Company. <br /> On April 13, 2001 you were sent a copy of Title 23, California Code of Regulations (CCR), Section <br /> 2670 (i). This section explains why the tanks are subject to full closure requirements. The <br /> abandonment of these tanks due to improper closure is a violation of HSC Section 25298. A <br /> property owner's liability for civil penalties for each day of these continuing violations is covered in <br /> HSC Section 25299 (a)(5) and (b)(3). <br /> A complete copy of Chapter 6.7 of the Health and Safety Code and Title 23 of the California Code of <br /> Regulations is enclosed for your reference. Since you have indicated in your June 11,2001 letter that <br /> you do not understand these laws and regulations, you may wish to discuss these with your legal <br /> counsel. <br /> As the property owner, you are responsible for the immediate proper closure of the three <br /> underground storage tanks at this location.
