EHD records show that on February 7, 2008, you received a letter from the EHD <br /> notifying you of a violation of California Health and Safety Code Section 25284 relating to the <br /> permit to own or operate underground storage tanks and requesting that you submit the <br /> required forms to the EHD. As of this date, the EHD has not received an application to <br /> operate the UST system at the site. <br /> On January 25, 2008, invoices were mailed out for the 2008 UST operating fees as well as <br /> other associated fees. All fees are due and payable at this time. As of this date, the EHD has <br /> not received payment for these fees. <br /> Violations: <br /> California Health and Safety Code Section 25284(x)(1) — Except as provided in subdivision <br /> (c), no person may own or operate an underground storage tank unless a permit for its <br /> operation has been issued by the local agency to the owner or operator of the tank. <br /> California Health and Safety Code Section 25284(c) —Any person assuming ownership of an <br /> underground storage tank used for the storage of hazardous substances for which a valid <br /> operating permit has been issued shall have 30 days from the date of assumption of <br /> ownership to apply for an operating permit pursuant to Section 25286 or, if accepting a <br /> transferred permit, shall submit to the local agency the completed form accepting the <br /> obligations of the transferred permit. <br /> California Health and Safety Code Section 25299(x) —Any operator of an underground tank R <br /> system shall be liable for a civil penalty of not less than five hundred dollars ($500) or more <br /> than five thousand dollars ($5,000) for each underground storage tank for each day of <br /> violation for any of the following violations: (1)-Operating an underground tank system which <br /> has not been issued a permit, in violation of this chapter. <br />
