USTMAN has developed computer software and u providing Y- Mgnjw=P and mamag&ment Services using the "Statistical Inventory Reconciliation" (SIR) method of release detection for petroleum underground storage tank systems (USTs). B. Customer will provide information to USTMAN relating to Customer's underground storage tanks and USTMAN will analyze that information and assist Customer in maintaining compliance with federal and state regulations regarding leak detection for tanks and piping. USTMAN will receive and hold Customer's UST information in confidence. independent third Ply C The t tSTNLAN SIR System has been certified by two nationally recognizedP laboratories as meeting Federal performance standards for SIR methods. (A copy of the evaluation report(s) applicable to customer's USTs is/are attached hereto and should be retained in Customer's files for review by regulatory agencies). AGREEMENT:as follows: In consideration of the mutual covenants and conditions contained herein. the parties agree I. Customer hereby retains USTMAN to perform h"ooLv Dro-'tonne and D"apaoement Services utilizing the USTMAN SIR System on designated USTs owned and/or operated by Customer. 2. Customer shall provide USTMAN, on a monthly basis, daily inventory information in accordance with USTMAN's current operating procedures. USTMAN will -analyze the information provided - and prepare reports of such analyses for Customer. USTMAN will not disclose such information to not apply to information which others without Customer's written consent , except that this does n USTMAN holds without secrecy obligation or which is disclosed pursuant to order of court 3. Customer shall pay fees for this service as follows: 2 tanks at $26.00 each per month for 24 months for a total of $1248.00. One time set up fee of $35.00 each for $70.00. TOTAL CONTRACT TO BE FOR $1318.00. (see bottom of pagg�e for payments) 4_ This agreement shall be effective as of the first day of ma=y 1943 ,which is the fust month for which UST data shall be submitted, and shall continue for 9 year(s). Upon expiration of the primary term, this agreement shall be automatically renewed for successive additional 1 year terms unless written notice of non -renewal is given by either party at least 60 days prior to the expiration date. Any such renewal shall be at fees in effect at the expiration date unless USTMAN gives notice of a new fee schedule at least 90 days prior to expiration date, in which case the new fee schedule shall apply.
