(209) 46$-3420 <br />Fax: (209) 464-0138 <br />NOTICE TO ABATE IMMEDIATELY <br />December 11, 2007 <br />Julie L Adamek <br />80155 Gallatin Rd <br />Bozeman MT 59715 <br />RE: Abandoned Underground Storage Tanks <br />6426 East Haight Road, Lodi (APN 06115038) <br />DIR€CTIL E COPY <br />Donna Heran, REHS <br />ASSISTANT DIRECTOR <br />Laurie Cotulla, REHS <br />PROGRAM COORDINATORS <br />Carl Borgman, REHS <br />Alike Huggins, REHS, RDI <br />Margaret Lagoric, REHS <br />Robert McClellon, REHS <br />Jeff Carruesco, REHS, RDI <br />Kasey Foley, REHS <br />The San Joaquin County Environmental Health Department (EHD) was notified on <br />October 8, 2007 of the presence of two abandoned 500 -gallon underground <br />storage tanks on the above noted property. <br />An investigation by EHD has revealed the following: <br />• The pumps for the underground storage tanks were removed over 20 years <br />ago and the tanks were not used to fuel farm equipment since that time. <br />• The underground tanks were not in use since the time of the pump removal <br />and were not removed or decommissioned at that time. <br />• The underground storage tanks were observed at the site on August 16, <br />2007 by a representative of Neil O. Anderson and Associates. <br />Based on the information above it has been determined that that the underground <br />storage tanks at this site are regulated tanks pursuant to the California Code of <br />Regulations, Section 2621(c). <br />Violations: <br />• California Health and Safety Code, Section 25298(a): No person shall <br />abandon an underground tank system or close or temporarily cease <br />operating an underground tank system, except as provided in this section. <br />California Health and Safety Code, Section 25299(b)(3): Abandonment or <br />improper closure of any underground storage tank system subject to this <br />chapter. <br />California Health and Safety Code, Section 25299(b)(1): Failure to obtain a <br />permit as specified by this Chapter. <br />
