1 Debtor to Barclays under the Continuing Guaranty Agreement to pay <br /> 2 and perform such obligations of BC Investment to Barclays) . <br /> 3 F. As of the Petition Date, the BC Obligations were in the <br /> 4 aggregate amount of $2 , 429, 484 .47, which amount was comprised of <br /> 5 (i) outstanding principal under the Real Estate Term Note in the <br /> 6 amount of $2, 395, 832 . 97 , and (ii) accrued interest on the Real <br /> 7 Estate Term Note in the amount of $33 , 651. 50, as computed according <br /> S to a variable rate formula (when last adjusted, at the rate of $657 <br /> 9 per diem) . <br /> 10 G. The BC Obligations were secured by: <br /> TT (i) a lien against and a security interest in the Real <br /> 12 Property Collateral, as more particularly described in the Deed of <br /> 13 Trust, Assignment of Rents, Security Agreement, and Fixture Filing <br /> 14 executed by BC Investment in favor of Barclays dated as of <br /> 15 June 13 , 1990 (the "Deed of Trust") , a copy of which is attached as <br /> 16 Exhibit D to the Proof of Claim, and <br /> 17 (ii) substantially all of Debtor's real and personal <br /> 18 property, including, without limitation, all accounts, inventory, <br /> 19 equipment, fixtures, general intangibles, monies, instruments, <br /> 20 documents, intellectual property and other property as more <br /> 21 particularly evidenced and described by (a) the Loan and Security <br /> 22 Agreement, (b) the Continuing Guaranty Agreement, (c) the Leasehold <br /> 23 Deed of Trust, Assignment of Rents, Security Agreement, and Fixture <br /> 24 Filing executed by Debtor in favor of Barclays dated as of June 13 , <br /> 25 1990 (Exhibit E to the Proof of Claim) , and (d) the UCC-1 Financing <br /> 26 Statement executed by Debtor in favor of Barclays (Exhibit F to the <br /> 27 Proof of Claim) (collectively, the "Security Documents") . <br /> NOTICE OF JOINT MOTION AND JOINT MOTION FOR <br /> ORDER AUTHORIZING COMPROMISE OF CONTROVERSY AND <br /> APPROVING STIPULATION FOR RELIEF FROM STAY 3 3435\P006A.LJC/dcl <br />
