Hazelton Avenue, Stockton, California My client, Attorney Donald D. Boscoe, has requested that I communicate with you relative to the application for this project. The application for closure and fees therefore of two hundred thirty four dollars ($ 234.00) were received by San Joaquin County, Environmental Health Division on 2 November, 1994. On the same day, 2 November, 1994, I notified you by fax (Enclosure 1) , that an error existed on the original application. The correct owner name for this project should have been "Estate of Williams, et.al .". On 22 November, 1994, you notified me by telephone and your memorandum, dated 22 November, 1994 (Enclosure 2) that three items were necessary to complete the application as follows: (1) new application for closure with corrected applicant name and new signature (2)new authorization to release with corrected name and new signature and (3) workman compensation waiver. You also indicated that back fees, penalties and state surcharges were due for this site. On 22 November, 1994, I mailed to you all items you requested indicating the corrected owner's name which were resigned by Attorney Boscoe as Agent for the estate: I also enclosed a signed workmans compensation waiver: As indicated by my letter to you of 22 November, 1994 (Enclosure 3) , I passed on the fee schedule to Attorney Boscoe as he is the Agent for the estate. Attorney Boscoe has indicated to me that he has met with someone at Environmental Health; I believe it was Mr. Doug Wilson. Attorney Boscoe disputes the fees are due which Environmental Health is requesting. Attorney Boscoe recently received a new billing, jEnclosure 4) from Environmental Health. Please note that the name of the owner is in error and has not been corrected. He has also asked that I explain this invoice to him. I could only indicate that it appears to me that the estate has been billed 3.3 hours for plan check at the billing rate of $ 78.00 per hour. He reviewed the submittal and indicated he felt it could be read in about ten minutes.and feels this billing is not justified. He is also perplexed relative to the time frame regarding this application with no permit issued. He further raised the issued of his letter to you of 5 January, 1995 (Enclosure 5) to which he has not received a response. I request that you communicate directly with Attorney Boscoe regarding all fees relative to this application beyond the standard three hours which I have already paid for with the original submittal . I also request that you respond directly to Attorney Boscoe regarding his communication to you of 5 January, 1995. The EPA I.D. number which I origihally obtained for this site has also expired. When I am informed that this application is approved and the project may be implemented, I shall obtain a new I,D. number and notify you. Thankyou for your consideration.
