Hazelton St. , Stockton <br /> Dear Ms. Briggs: <br /> Pursuant to my recent telephone conversation with you <br /> regarding the tank removal project at 816 East Hazelton Street, in <br /> Stockton, California, I submit the following: <br /> Exactly one year ago in mid January 1994, I employed Mr. James <br /> Hoblitzell , who was then working with another client of mine on a <br /> contamination problem, to inspect the above property and ascertain <br /> if there was or ever had been a subterranean tank for gasoline <br /> storage. After this inspection, I was advised that there was a 1000 <br /> gallon tank at this location partially exposed. In his opinion it <br /> was very old. <br /> I have been the attorney and a personal friend of the owners <br /> of this property for over 30 years and I have personal knowledge <br /> that none of the owners of this property, nor did I have any <br /> knowledge that the tank had ever been in use. I have leased the <br /> property during this period of time and I am now prepared to show <br /> that never had this tank been used nor required or mentioned in any <br /> of the leases I have so prepared. <br /> When I was finally advised by Mr. Hoblitzell that an <br /> additional sum of $2 ,072 in fees as penalties was required for its <br /> removal, you can readily understand the shock I sustained. I know <br /> that the law affecting these old tanks did not make any impression <br /> on innocent owners until the mid 1980's. <br /> In this case one of the substantial owners is a widow who <br /> relies on the income from this property to supplement her support <br /> and to obtain medical services for a very serious illness . More <br /> recently, her demand for care and medical attention has become so <br /> large that she must sell the property to obtain immediate funds to <br /> meet these expenditures. <br />
