No. GST 820 Exhibit A Page 2 of 2 STANDARD CLAUSES - CONTRACTS $5,000 AMD OVER WITH NONPUBLIC ENTITIES Cootrartor or-ecipient shall permit as ess by representatives of the Department of Fair Employment and-ou_irg and the awarding State agency upon reasonable rot;ce at any time during the normal business_ hours, but in no case less than 24 tours notice, to such of its books, records, accounts, other sources of information and its facilities as said Department or Agency shall require to ascertain compliance with this clause. Re—pie,-,t, Contractor and its subcontractors shall give written notice of their obligations under this clause to labor organizations with which they have a collective bargaining or other agreement. The Contractor shall include the nondiscrimination and compliance provisions of this clause in all subcontracts to perform work under the contract. STATEMENT OF COMPLIANCE The Contractor's signature affixed hereon and dated shall constitute a certification under the penalty of perjury under the laws of the State of California that the Contractor has, unless exempted, complied with the nondiscrimination program requirements of Government Code, Section 12990 and Title 2, California Administrative Code, Section 8103. PERFORMANCE EVALUATION Contractor's performance under this contract will be evaluated after completion. The evaluation will be filed with the Department of General Services. AVAILABILITY OF FUNDS Work to be performed under this contract is subject to availability of funds through the State's normal budget process. AUDIT CLAUSE The contracting parties shall be subject to the examination and audit of the Auditor General for a period of three years after final payment under the contract (Government Code, Section 10552). PAYMENT RETENTION CLAUSE Ten percent of any progress payments that may be provided for under this contract will be withheld per Public Contract Code, Section 10346. Contractor may substitute securities for such retention as stipulated by Government Code, Section 4590 and shall receive any interest thereon.
