This <br /> letter is to establish the schedule for the submission of your <br /> Operation Plan (OP) for this hazardous waste storage facility. <br /> The 8, 252 gallon waste acetone tank is regulated by this <br /> Department pursuant to the Health and Safety Code Section <br /> 25123 . 3 , Subdivision (a) (2) . Section 25123 . 3 (a) (2) of the <br /> Health and Safety Code states: " (a) "Storage facility" means a <br /> hazardous waste facility at which the hazardous waste meets any <br /> of the following requirements: (2) The hazardous waste is <br /> contained in a tank for any period of time and the quantities of <br /> the hazardous waste exceed 5, 000 gallons or 45, 000 pounds , <br /> whichever is greater. " <br /> The Department is now initiating the permitting process for your <br /> facility. As part of this process, an OP and Part A application <br /> must be submitted to this office within 60 days of the date of <br /> this letter. The OP must meet all of the requirements of the <br /> enclosed "Instructions for Preparation of an OP for a Hazardous <br /> Waste Facility" , and the Title 22 , California Administrative Code <br /> regulations. (Order form enclosed) . <br /> Please be aware that failure to submit a satisfactory OP within <br /> 60 days, could result in the denial of your permit. Without a <br /> final permit, storage of hazardous wastes in the tank is not <br /> allowed pursuant to the provisions of the Health and Safety Code. <br />
