LODI AVE., LODI <br /> Returned call to Kevin Reilly (334-6144) concerning back UST fees for 100 E. Lodi Ave., Lodi, <br /> that he received for 3 unregistered tanks, totaling $6, 162.50. Recently, he did pay tank closure <br /> fees and had the tanks removed 7-16-98 under EHD permit and inspection. Mr. Reilly did not <br /> want to pay the penalties, but stated that he would pay back active fees totaling $3,060. He <br /> admitted that he knew he had the tanks and "that he would have to remove them some day," but <br /> did not know about the high fees and that the EHD should have personally notified him. Mr. Reilly <br /> wanted to know why the fees were so high. I informed Mr. Reilly that all other UST facilities had to <br /> register their tanks and pay fees since 1986. Mr. Reilly demanded to know about the appeals <br /> process. I stated the only appeal would involve tanks that are not visible and discovered without <br /> former knowledge of the property owner, but he already indicated he knew about these tanks, <br /> since he sold gas through 1981. Mr. Reilly wanted the fees changed and I informed him that I did <br /> not have the authority to change his fees. Mr. Reilly stated that there should be some appeal for <br /> him because he disagreed with the fees. Mr. Reilly stated that he wanted to go to the Board of <br /> Supervisors and I told him he had the right to so if he wishes, but I could not personally change <br /> the fees. <br />
