Hazelton Ave. <br /> Stockton, CA 95205 <br /> Dear Mr. Wilson: <br /> This letter is being sent as a follow up to our conversation of <br /> September 11, 1991 regarding the exemption status of the SPCC <br /> tank located at 3015 Navy Dr. , Stockton, California. <br /> Time Oil Co. would like to confirm your interpretation of the <br /> exempt status of this tank as described under the California Code <br /> of Regulations, Title 23 Waters, Division 3 State Water Resources <br /> Control Board, Chapter 16 Underground Tank Regulations, Article <br /> 2 , Section 2621 Exemptions, (a) , (12) , regarding emergency <br /> containment tanks. <br /> It is our understanding that this tank now falls under the <br /> category of an emergency containment tank designed to receive <br /> accidental spills and is therefore exempt from the requirements <br /> of the California underground storage tank laws. It is also our <br /> understanding that annual renewal fees, permits, forms A and B <br /> and quarterly reports are no longer required. <br /> Please contact this office if you have any comments or concerns <br /> about our discussions or this interpretation.
