April 24, 1987 i
Page 2
However, even if that permit had been issued (or for some reason that we
do not understand, it is not required to be issued before a permit fee
can be assessed for 1987) then it would seem that it is inappropriate to
assess an additional $50 fee for 1986 as well as the $56 tank surcharge
fee for that tank. When the permit application was filed in February
1986, the application included the sum of $150 for the annual inspection
fee for the existing facility and the first tank (i .e. the 5,000 gallon
tank) together with the $56 State surcharge for that tank. Accordingly,
both of those fees were paid for 1986 with the submission of the permit
application of February 1986 and should not be assessed again.
We would appreciate any assistance you can give us in resolving these
questions. I assure you that we are anxious to comply with the spirit as
well as the letter of applicable laws and regulations. However, in all
candor, for the reasons set forth above we simply do not understand how
these fees can be assessed.
Very truly yours,
TIME GIL CO.
Terrill L. err erson
Corporate Counsel
TLH:pjv
Enclosures a/s
0244C
