In determining whether a violation is <br />chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the <br />violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including <br />corrective action). <br />1. No permit to operate (HSC 25284). <br />2. Current financial responsibility documents not submitted (HSC 252922) <br />3. UST operating permit application for facility and tank information not submitted or current (CCR 2711). <br />4. Failed to have an approved UST monitoring plan (CCR 2632(d)(1). <br />5. Failed to have an approved UST response plan (CCR 2632(d)(2). <br />6. Plot plan/site map not submitted or failed to completely show where monitoring is performed (CCR 2632(d)(1)(C). <br />7. Failed to test monitoring and leak detection equipment annually (CCR 2638(a). <br />8. Failed to inform the EHD of designated operator identification or change within 30 days (CCR 2715(a). <br />9. Current monitoring plan approved by the EHD not found on site (CCR 2712(i) <br />10. Failed to have an approved UST response plan available on site (CCR 2712(i). <br />11. Failure to comply with UST operating permit conditions (CCR 2712) <br />12. Monitoring in sump/UDC failed to activate an audible and visual alarm or stop the flow of product (CCR 2636(f)(1) <br />13. Failed to perform 0.1 gph annual line test for pressurizing piping without fail safe or shut down (CCR 2636(f) <br />14.
