Mc Donald, <br /> of Dorazio, Barnhorst and Bonar, attorneys for the Port of Stockton, <br /> and the correspondence from William H. Parish, attorney for the <br /> Bank of Stockton, it appears that Energy Petroleum, Inc . , has filed <br /> voluntary bankruptcy , and that possession of the real property <br /> at the Port of Stockton where the tanks in question are located, <br /> has been returned to the Port of Stockton sometime prior to duly <br /> 17 , 1987 . It is our further understanding that the underground <br /> storage tanks are still in place. <br /> I have been advised by my attorney that under the law of the State <br /> of California, the Port of Stockton became the owner of those tanks <br /> at such time as possession of the real property was returned to <br /> the Port . Therefore , the Port of Stockton is obligated to comply <br /> with the provisions of the Underground Storage of Hazardous Substances <br /> law, Health and Safety Code, commencing with Section 25280 . I <br /> call your attention , in particular, to the following provisions: <br /> 1 . Section 25284(c) of the Health and safety Code requires <br /> any person assuming ownership of an underground storage <br /> tank to apply for an operating permit or to accept the <br /> obligations of a transferred permit . <br /> 2 . Section 25298 of the Health and Safety Code provides for <br /> the abandonment , closing or temporary ceasing of operation <br /> of underground storage tanks , which applies to you if the <br /> tanks are not now in use. <br />
